These Terms & Conditions apply to the website www.thewihanmethod.co.za and to tutoring services provided by The Wihan Method, operated by Wihan Swanepoel / Willem Johannes Swanepoel as a sole proprietor.

By accessing this website, submitting an enquiry, booking a lesson, completing a form, ticking an acceptance box, or using any tutoring service offered by The Wihan Method, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, you should not use this website or book tutoring services.

2. Services Provided

The Wihan Method provides academic tutoring services, mainly for:

Mathematics: Grade 7 to Grade 9

Tutoring may take place online, in person, or at another agreed location.

Tutoring is intended to support the student’s school learning. It does not replace school instruction, school attendance, homework responsibility, or the student’s own effort.


3. Parent / Guardian Consent

Where the student is under 18 years old, the person booking or accepting tutoring services confirms that they are the student’s legal parent or guardian, or that they have the necessary authority to enter into this agreement on behalf of the student.

By booking tutoring services, the parent or guardian gives permission for the student to receive tutoring from The Wihan Method.


4. No Guarantee of Results

The Wihan Method will provide professional academic support, lesson preparation, feedback, and guidance.

However, no specific marks, grades, test results, school outcomes, or academic improvements are guaranteed. The student’s progress depends on many factors, including attendance, effort, practice, schoolwork, and preparation.


5. Fees and Payment

Tutoring fees will be confirmed before services begin.

Unless otherwise agreed in writing:

Payment is due immediately after each tutoring session by EFT.

Late payments may result in tutoring services being suspended until the account is up to date.

A late payment penalty of R15 per week overdue may be charged on unpaid amounts.

The Wihan Method reserves the right to refuse further lessons where payment remains outstanding.


6. Attendance and Cancellations

Parents or guardians must provide at least 24 hours’ notice to cancel or reschedule a session.

Sessions cancelled with less than 24 hours’ notice may be charged in full.

Missed sessions without notice will not be refunded or rescheduled.

If The Wihan Method cancels a session, the session will either be rescheduled or not charged.

Students are expected to arrive on time and be ready for the lesson. Late arrival may result in a shorter lesson, and the full lesson fee may still apply.


7. Student Behaviour and Code of Conduct

Students are expected to participate respectfully and without unnecessary disruptions.

The Wihan Method reserves the right to stop a session if the student’s behaviour is inappropriate, disrespectful, disruptive, unsafe, or prevents the lesson from continuing properly.

Repeated misconduct may result in tutoring services being suspended or terminated.


8. Academic Integrity

The Wihan Method will not complete assignments, projects, tests, exams, or schoolwork on behalf of the student.

Tutoring support is provided to help the student understand the work, improve their skills, and develop confidence. It is not a substitute for the student’s own work.


9. Responsibilities of the Parent / Guardian

The parent or guardian agrees to:

Ensure the student attends lessons on time.

Ensure the student has the necessary books, notes, stationery, device, internet connection, or materials needed for the lesson.

Make payment on time.

Communicate any relevant academic concerns, learning needs, or scheduling issues.

Ensure that the student completes any practice work or revision tasks given by the tutor.


10. Responsibilities of The Wihan Method

The Wihan Method agrees to:

Prepare and provide tutoring lessons.

Support the student’s understanding of the subject.

Provide feedback where appropriate.

Treat the student and family with respect.

Keep personal information confidential, unless disclosure is required by law.

Provide tutoring services in a professional and responsible manner.


11. Online Lessons

For online lessons, the parent or guardian is responsible for ensuring that the student has a suitable device, working internet connection, and quiet learning environment.

The Wihan Method is not responsible for technical issues outside its control, including internet failure, load shedding, device problems, software issues, or platform interruptions.

If an online lesson cannot continue due to technical problems, The Wihan Method may decide, at its discretion, whether to reschedule the lesson, continue later, or charge for the time already spent.


12. Safety During Lessons

For in-person lessons, the parent or guardian is responsible for ensuring that the learning environment is safe and appropriate.

The Wihan Method is not responsible for the student’s personal safety outside the agreed tutoring session time.

The parent or guardian remains responsible for the student before and after the lesson.


13. Emergency Consent

In the event of an emergency during a tutoring session where the parent or guardian cannot be contacted, the parent or guardian authorises The Wihan Method to seek immediate medical assistance for the student if reasonably necessary.

The parent or guardian agrees to be responsible for any related medical or emergency costs.

The Wihan Method will make reasonable efforts to contact the parent or guardian before seeking medical assistance where possible.


14. Personal Information and Privacy

The Wihan Method may collect and process personal information such as names, contact details, student grade, school-related information, lesson progress, scheduling details, and payment information.

This information is collected and used for purposes such as:

Providing tutoring services.

Communicating with parents or guardians.

Scheduling lessons.

Sending feedback and invoices.

Keeping basic academic and administrative records.

The Wihan Method will take reasonable steps to keep personal information secure and will not share personal information with third parties unless required by law, necessary for providing the service, or consent has been given.

Personal information may be kept for up to 1 year after tutoring ends for administrative and record-keeping purposes, unless a longer period is required by law.

This section should be read together with the website’s Privacy Policy.


15. POPIA Consent

By submitting personal information through this website, booking tutoring services, or accepting these Terms & Conditions, the parent or guardian consents to The Wihan Method collecting, storing, and processing personal information for the purposes described above.

The parent or guardian understands that providing the necessary personal information is voluntary, but that tutoring services may not be possible without it.

The parent or guardian may request access to, correction of, or deletion of personal information where legally possible.


16. Communication Consent

By using this website, submitting an enquiry, or booking tutoring services, the parent or guardian consents to being contacted by The Wihan Method for service-related communication, including:

Lesson scheduling.

Lesson reminders.

Progress feedback.

Invoices and payment follow-ups.

General tutoring arrangements.

Communication may take place by WhatsApp, phone, SMS, or email.

Marketing messages will only be sent where allowed by law or where consent has been given.


17. Media, Photos, and Marketing Material

The Wihan Method will not use a student’s image, photograph, video, lesson screenshot, name, or identifiable information for marketing purposes without separate consent from the parent or guardian.

This consent should be obtained separately from these general Terms & Conditions.

Recommended checkbox wording:

I consent to The Wihan Method using photos, videos, or lesson-related images of my child for marketing or social media purposes.

I do not consent to The Wihan Method using photos, videos, or lesson-related images of my child for marketing or social media purposes.


18. Limitation of Liability

The Wihan Method will not be held responsible for:

The student’s school marks, grades, academic results, or performance.

Losses caused by missed lessons, late arrivals, lack of preparation, or incomplete practice work.

Technical problems during online lessons.

Injuries, losses, or damages occurring outside the agreed tutoring session time.

Events outside The Wihan Method’s reasonable control.

Nothing in these Terms & Conditions is intended to unlawfully limit any rights that a consumer may have under South African law.


19. Indemnity

The parent or guardian agrees to indemnify and hold harmless The Wihan Method, its owner, and tutor against claims, losses, damages, injuries, or expenses arising from:

The student’s conduct.

Unsafe learning environments.

Incorrect information supplied by the parent, guardian, or student.

Failure to follow instructions or safety guidelines.

Events occurring outside the agreed tutoring session time.

This indemnity does not apply where the law does not allow liability to be excluded.


20. Termination of Tutoring Services

Either party may end tutoring services by giving one week’s written notice.

The Wihan Method may terminate services immediately if there is:

Repeated misconduct.

Non-payment.

Abuse, harassment, or disrespectful communication.

Breach of these Terms & Conditions.

Unsafe tutoring conditions.

Any prepaid sessions may be refunded or forfeited depending on the circumstances and the reason for termination.


21. Force Majeure

The Wihan Method will not be liable for failing to perform its obligations where this is caused by events beyond reasonable control, including but not limited to:

Load shedding.

Power failures.

Internet disruptions.

Illness.

Emergencies.

Government restrictions.

Natural disasters.

Platform or technology failures.

In such cases, The Wihan Method may reschedule the affected session where reasonably possible.


22. Website Use

Users agree not to misuse this website.

You may not:

Attempt to hack, damage, overload, or interfere with the website.

Copy website content for commercial use without permission.

Submit false, abusive, harmful, or misleading information.

Use the website in a way that violates any law.

The Wihan Method may restrict access to the website or services where misuse is suspected.

25. Electronic Acceptance

These Terms & Conditions may be accepted electronically.

By ticking an acceptance box, submitting a form, typing your name, booking a lesson, or continuing to use the services, you confirm that you understand and accept these Terms & Conditions.

Where a parent or guardian types their name, ID number, or submits an online agreement form, this may serve as electronic confirmation of acceptance.


26. Dispute Resolution

If a dispute arises, both parties agree to first try to resolve the matter through direct discussion.

If the dispute cannot be resolved, the parties may attempt mediation before taking further legal steps.


27. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes will fall under the jurisdiction of the appropriate South African court, where applicable.


28. Changes to These Terms

The Wihan Method may update these Terms & Conditions from time to time.

The latest version will be published on this website.

Continued use of the website or tutoring services after changes are published means that you accept the updated Terms & Conditions.
